Working for a world where every person's right to a fair trial is respected, whatever their nationality, wherever they are accused
EAW article in New Journal of European Criminal Law
Catherine Heard, Head of Policy at Fair Trials International
Catherine Heard and Daniel Mansell, FTI's Head of Policy and Policy Officer, write on the role of the judiciary in protecting human rights in European extradition cases, in particular the impact of the ECHR decision in Mss v Belgium & Greece.
The article proposes strengthening human rights safeguards within the European Arrest Warrant system, including amending the framework decision to allow requested states, once alerted to a serious risk of rights infringement, to ask issuing states for further information and, where necessary, to seek guarantees that the fundamental rights of the requested person will be respected.
