Working for a world where every person's right to a fair trial is respected, whatever their nationality, wherever they are accused

Patrick Malluzzo - India

“I have waited seven long years for the day I would be reunited with my son. Throughout this long ordeal we have been moved by the huge amount of support we have received and in particular from Fair Trials International who without their assistance I’m not sure we would have had the strength to carry on fighting.”
Teresa Malluzzo, Patrick's mother

Young backpacker spends over seven years in an Indian jail following unfair trial and brutal torture

Patrick was arrested in 2004 during a back-packing trip in India after 3 bags (one containing cannabis) were found under seats booked under Patrick and an acquaintance’s name. Patrick was never on the train where the bags were found and no witnesses have linked Patrick to possession of the bag containing drugs. Patrick has reported brutal torture by Indian police and was forced to make a televised confession. Patrick waited for over two years for a trial after his arrest for it only to be a travesty of justice: he had poor legal representation, could not understand the proceedings and was given no opportunity to give evidence or call witnesses. He was found guilty in 2006 and it took over four years for the Rajasthan High Court to hear his appeal.

After seven years’ in an Indian jail, Patrick’s health deteriorated so much that he took the difficult decision not to take the case to the Indian Supreme Court, which could have meant him spending another two years in an Indian jail. Patrick was transferred to a UK prison on 1 February 2011.
