EU Evidence
The European Investigation Order (EIO) is a proposed new EU law which will dramatically transform the way in which evidence is obtained and shared between EU countries in criminal cases.
Fair Trials International welcomes legal measures which facilitate the lawful gathering and safeguarding of all evidence relevant to an alleged offence. Clearly, the more legally obtained evidence that is available, the more likely it is that a trial will be fair. However, we have major concerns about the current text of the EIO and its failure to protect fair trial and privacy rights. We have called for key safeguards to ensure that individuals are protected from unwarranted or disproportionate interferences with their fundamental rights in the context of cross-border evidence-gathering.
The concerns we raised on the EIO have since been echoed by many others both in the UK and across Europe. As the negotiations continue we will maintain pressure for the necessary safeguards before this law is passed.
